We normally visit the property before pricing, and any figure we give before that visit is indicative only. Written estimates are based on the information available and the scope described at the time. ## Instructing work A contract is formed when you accept our written proposal and we confirm acceptance. The proposal, together with any drawings, specifications and schedules referred to in it, sets out the agreed scope. Where a project requires planning permission, building regulations approval, party wall notices or other consents, obtaining them is the client's responsibility unless our proposal states that we will handle them. ## Variations and unforeseen work Changes you request, and conditions that could not reasonably be seen at the time of pricing, for example concealed structure, ground conditions or existing drainage - are dealt with as variations. We will tell you the cost and any programme effect before proceeding wherever it is practical to do so. ## Programme Programme dates are our realistic assessment based on the agreed scope. They can be affected by variations, third-party consents, client-supplied materials or decisions, and matters outside our reasonable control such as severe weather. ## Payment Payment terms, including any stage payments, are set out in the proposal for your project. Materials remain our property until paid for. We reserve the right to charge statutory interest on sums that remain overdue. ## Workmanship guarantee We stand behind our work with a workmanship guarantee. The length and terms depend on the project, so they are confirmed in your proposal, ask us for the detail relevant to your work. Manufacturers' warranties for products and materials are passed to you where they apply. The guarantee does not cover fair wear and tear, damage caused by others, lack of maintenance, or alterations carried out by another party. ## Insurance and liability We carry the insurance appropriate to the work we undertake; current cover details are available on request. Nothing in these terms limits liability for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. Otherwise our liability is limited to the value of the contract for the work concerned, and we are not liable for indirect or consequential loss. ## Consumer cancellation rights Where you engage us as a consumer away from our premises, you have a statutory cancellation period. If you ask us to begin work within that period and then cancel, we may charge for work already carried out and materials ordered. ## Governing law These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
